Hero Haul Moving Services – Customer Terms and Conditions

Dear valued customer, thank you for choosing Hero Haul Moving Services for your relocation needs. We are delighted to offer this comprehensive estimate tailored to your specific moving requirements. This binding estimate is carefully designed to accurately represent the services provided by Hero Haul, ensuring transparency in the pricing structure for your direct move. Please be aware that any deviations from the listed services may result in the issuance of a new estimate, in accordance with our policies and federal regulations (49 CFR § 735.403(a)(6(ii)).

SERVICES INCLUDED IN THIS ESTIMATE:

  1. Direct transportation of goods using Hero Haul’s dedicated fleet of vehicles.
  2. Expert guidance and support throughout the entire move.
  3. Disassembly of standard furniture for secure transport.
  4. Protective wrapping of all furniture using quilted/padded moving blankets.
  5. Itemized inventory detailing the condition of items at the origin.
  6. Loading and unloading of all goods.
  7. All transportation-related expenses, taxes, tolls, mileage, and fuel surcharges.
  8. Standard cargo protection up to $10,000 based on 0.60 cents per lb. per article.
  9. No additional charges for elevator use.
  10. Complimentary moving pads.
  11. Free date change with no penalties if requested 14 calendar days before the original scheduled pick-up date. (Summer rates subject to change)
  12. Expedited delivery services available upon request.

* Note: Complex furniture items requiring disassembly/reassembly may involve additional labor or third-party professionals. Please disclose such items in advance. Disconnecting/reconnecting appliances is not included. Additional services like packing, materials, and unpacking are available at an extra charge.

OPTIONAL ACCESSORIAL SERVICES AND ADDITIONAL FEES:

We provide various optional services such as packing, unpacking, appliance delivery, specialty items, furniture disassembly, re- assembly, and guaranteed delivery. Additional charges may apply for services not explicitly listed on the estimate, including:

  • First 7 stairs included. Additional fee for stairs above the 2nd floor.
  • Long carry: First 75 feet included. Additional footage at a minimum rate of $75.00 per 75 feet.
  • Packing of fragile items, packing supplies, and other specific requests.
  • Specialty Items and Heavy Items. $500 fee for items over 450 lbs.

DELIVERY ETA SCHEDULE:

Estimated delivery times based on distance:

  • 0-500 miles: 0-2 business days.
  • 501-1000 miles: 2-5 business days.
  • 1001-1500 miles: 2-7 business days.
  • 1501-2000 miles: 3-10 business days.
  • 2001-3300 miles: 5-10 business days.

Maximum: 10 business days. (Expedited delivery services available upon request. This schedule is not a guarantee.)

TERMS OF PAYMENTS:

Upon booking, a 30% deposit (plus a binding estimate fee) is required. Different payment milestones apply before pickup, at delivery, and during the moving process. Payment methods include credit card (3% fee), cashier’s check, cash, or postal money order. Full payment is required before unloading, following specific guidelines subject to federal law.

CANCELLATION OF SERVICES:

Estimates can be canceled penalty-free within a 3-day window after signing the Moving Contract. After this period, deposits are non-refundable. Services cannot be canceled once physical moving services begin, i.e., packing, loading, or transportation.

NOTICE OF MAXIMUM AMOUNT DUE ON DELIVERY:

At Hero Haul Moving Services, we believe in transparency and providing clear information regarding your moving costs. Please take note of the following terms related to the maximum amount due at the time of delivery:

  1. Basis of Charges:
    • Final charges will be calculated based on the actual cubic feet/volume of the transported property and the services provided by Hero Haul.
  1. Maximum Amount Due at Delivery:
    • The maximum amount to be demanded at the time of delivery, prior to unloading, will be the sum of the non-binding estimate plus 10%, or 100% of the last binding estimate issued before services commence.
  1. Exceeding the Estimate:
    • It is essential to acknowledge that actual charges may exceed the estimated amount in the following scenarios:
    • Additional services were ordered or deemed necessary during the moving process.
    • The customer moved additional items, resulting in changes to the cubic feet/volume.
    • Extra service options, such as packing or storage, were required based on unforeseen circumstances.
    • Item over 450 lbs. not disclosed in initial estimate

CUSTOMER AGREEMENT:

By accepting this Binding Estimate for Services, you acknowledge that Hero Haul Moving Services is a direct mover handling all aspects of your move. The contract for moving services (Bill of Lading) is directly between you and Hero Haul Moving Services. You agree to pursue claims, including damage claims, directly with Hero Haul. Hero Haul Moving Services is the responsible party for the service contract.

PACKING, INSURANCE, AND VALUATION:

Packing services and materials are available at an additional charge. Hero Haul provides two valuation options: Limited liability and Full Replacement Value. Additional insurance for high-value items is recommended.

Hazardous materials, firearms, living plants, and perishable items are NOT accepted.

ESTIMATED PICKUP AND DELIVERY SCHEDULE:

Customers can choose Premium Guaranteed Service for specific delivery dates or Standard Service with a delivery window of up to 10 business weekdays. Delivery times are estimates and may vary due to factors beyond our control.

NEW BINDING ESTIMATES:

If additional items or services are required on the day of pickup, a new binding estimate may be issued. It’s crucial to provide a complete inventory to avoid last-minute changes.

CHOICE OF LAW, VENUE, AND JURISDICTION:

Any dispute resolution will be handled in the circuit or county court in and for Jefferson County, Colorado. Both parties agree to submit to the jurisdiction of Colorado courts.

ACCEPTANCE OF TERMS:

By signing this agreement, you affirm that Hero Haul Moving Services has provided you with a dated copy of the estimate, and you acknowledge the terms, costs, and services outlined.

LIMITATION OF LIABILITY:

You understand and agree that Hero Haul Moving Services is not liable for indirect or consequential damages. Any claims for damages or losses must be pursued directly with Hero Haul Moving Services.

AGENT USE AND CLAIMS:

Hero Haul may use agents or independent subcontractors, and the motor carrier may use different vehicles for pickup and delivery. Claims for damages must be filed within 6 months of delivery.

DISPUTE SETTLEMENT PROGRAM:

We offer an arbitration program as an alternative dispute resolution. Arbitration is optional, and each party bears its own costs associated with the process.

RELEASE AND MARKETING AUTHORIZATION:

You have the option to receive updates, offers, and information relevant to your move. Your contact information may be shared with selected partners offering beneficial services. You may opt-out of communications at any time.

PROOF OF SERVICE DENIAL:

Hero Haul Moving Services is not required to provide proof of service denial. The customer assumes responsibility for service refusal documentation. As the Customer, I agree to the applicable terms and conditions relating to pickup and delivery dates detailed above. I agree that Hero Haul does not have the ability to obtain signed documentation verifying a service refusal. As the Customer, I agree that Hero Haul will not be required to provide proof of service in the case of a service denial or refusal of service. Hero Haul reserves the right to retain the deposit of the customer who verbally refuses or denies service without written documentation.

NOTICE AND WAIVERS:

In compliance with 49 CFR § 375.401(a) and 49 CFR §371.113(c)(1), the customer with Hero Haul agrees to forgo a physical survey or in-home estimate of household goods. Instead, the customer opts to receive a written email-generated Binding Estimate based on the provided item list of property to be transported and services ordered. The customer has acknowledged receipt of the FMCSA publications “Ready to Move? – Tips for a Successful Interstate Move” and “Your Rights and Responsibilities When you Move” via email hyperlink and accessed the Federal consumer protection information online.

The terms outlined in this estimate and all services to be provided are subject to Hero Haul’s tariffs, incorporated by reference, and available for inspection upon reasonable request at Hero Haul’s offices.

ABBREVIATIONS AND DEFINITIONS:

  • Motor Carrier: Hero Haul Moving Services, the actual moving company responsible for packing, loading, storage, transportation, and offloading services.
  • Customer/Shipper: You, the customer, contracting Hero Haul for direct interstate domestic moving services.
  • Coordinator/Service Provider: Hero Haul Moving Services, serving as the direct mover, issuing the estimate, and handling all aspects of the move.

IMPORTANT NOTICE – ADDITIONAL ITEMS AT PICK-UP:

If you wish to add items or if the items’ volume differs from the estimate, please take note:

  1. Hero Haul may present a new binding estimate with adjusted rates.
  2. Do not allow loading or services before calling our office at 720-295-0073 to agree to the new estimate in writing.
  3. Contact us at least 3 business days before the scheduled pick-up date to avoid surprises. Failure to do so may result in a revised estimate at the time of pickup.

PARTNER OUTREACH CONSENT:

By signing this estimate, you acknowledge:

  • Hero Haul may contact you with updates, offers, and relevant information.
  • Your contact information may be shared with selected partners offering services such as insurance, utility setup, and home maintenance.

YOUR CHOICE TO STAY CONNECTED OR OPT-OUT:

We respect that preferences may change. If you decide you no longer wish to receive communications from Hero Haul or our partners, notify us in writing. We will promptly honor your decision and update your preferences.

BY PLACING A DEPOSIT WITH HERO HAUL MOVING SERVICES:

You confirm your agreement to the Terms & Conditions outlined above. You have read and agreed to the specific terms, costs, and services as detailed in this estimate.
